Background
Student1 is a middle school-aged student enrolled in the District. Because of Student’s concerning behavioral and social difficulties the District sought the Parent’s permission to evaluate Student to determine eligibility for special education and related services. Student’s father (hereinafter Parent) withheld consent for an evaluation. The District therefore requested this due process hearing to obtain an Order that Student be evaluated.
