INTRODUCTION AND PROCEDURAL HISTORY
[Student] (“student”) is a [teen-aged] student who has been identified as a student with a health impairment. The student resides in the Peters Township School District (“District”). On this record, the parties do not dispute that the student is a student with a disability under the Individuals with Disabilities in Education Improvement Act of 2004 (“IDEA”)1. The parties’ dispute centers on the student’s eligibility for an extended school year (“ESY”) program. The District found the student to be ineligible for ESY programming for the summer of 2014. The parent maintains that the student is eligible for ESY programming.
For the reasons set forth below, I find in favor of the District.
