Introduction
This matter arises under the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. § 1400 et seq. and Section 504 of the Rehabilitation Act of 1973 (Section 504), 34 C.F.R. Part 104.4.
This due process hearing concerns the educational rights of a student (Student) in the Belle Vernon Area School District (District). In practical terms, this decision resolves a dispute about where the Student will go to school for the remainder of the 2013-14 school year. The District has proposed to change the location in which services will be
provided. The Student’s parents (Parents) requested this hearing, and are demanding that the Student remain in [Student’s] current placement through the end of the 2013-14 school year.
