Background
The Student1 is an elementary school aged child who resides in the Bethlehem Area School District (hereinafter District). Pursuant to an evaluation conducted by the District, Student’s Parents (hereinafter Parents) asked for an independent educational evaluation (IEE) at public expense, specifically an independent neuropsychological evaluation and an independent speech/language evaluation because they believe the District’s evaluation was inappropriate. The District denied the Parents’ request, and filed for a due process hearing to defend its evaluation.
