Student is a xx year old former student of the Charter School who attended the Charter School’s 5th and 6th grades during the 2004-2005 and 2005-2006 school years. Student seeks compensatory education for the Charter School’s alleged failure to provide a free and appropriate public education (FAPE) while he attended the Charter School. Student’s parent also seeks payment of private school tuition for the 2006-2007 and 2007-2008 school years. For the reasons described below, I conclude that the Student was denied FAPE, and I award compensatory education, but I do not award payment of private school tuition.


Whether or not the Charter School failed to identify, evaluate and program for student appropriately while he was enrolled at the Charter School.
